Aggravated Habitual Sexual Offenders
Under Jessica’s Law, you are an aggravated habitual sexual offender if you have you have two or more convictions for sexually violent crimes, including any of the following:
- Rape charges
- Indecent liberties with a child
- Aggravated indecent liberties with a child
- Criminal sodomy
- Aggravated criminal sodomy
- Indecent solicitation of a child
- Aggravated indecent solicitation of a child
- Sexual exploitation of a child
- Aggravated sexual battery
- Aggravated incest
Your second conviction of any of these crimes results in a sentence of life in prison with no possibility of parole.
First-Time Offenders
If you are over the age of 18 and have a sex with someone under the age of 14, you can be sentenced for life, even if you have no prior history of sexual offenses. Someone over the age of 18 who is convicted of one of the below sexual offenses with a child under age 14 will be sentenced to life in prison, with a mandatory minimum term of imprisonment of not less than 25 years:
- Aggravated trafficking
- Statutory rape
- Aggravated indecent liberties with a child
- Aggravated criminal sodomy
- Promoting prostitution
- Sexual exploitation of a child
A conviction for these crimes with a minor results in a sentence of life in prison with no possibility of parole.
