Murder Charges In Kansas
The following is a list of murder and related violent crimes:
Murder in the First Degree: Pursuant to Kansas statute 21-3401, murder in the first degree is the killing of a human being committed:
- Intentionally and with premeditation; or
- in the commission of, attempt to commit, or flight from an inherently dangerous felony
First-degree murder carries a life sentence.
Murder in the Second Degree: Pursuant to Kansas statute 21-3402, murder in the second degree is the killing of a human being committed:
- Intentionally; or
- unintentionally but recklessly under circumstances manifesting extreme indifference to the value of human life
Voluntary Manslaughter. Pursuant to Kansas statute 21-3403, voluntary manslaughter is the intentional killing of a human being committed:
- Upon a sudden quarrel or in the heat of passion; or
- upon an unreasonable but honest belief that circumstances existed that justified deadly force
Involuntary Manslaughter. Pursuant to Kansas Statute 21-3404, involuntary manslaughter is the unintentional killing of a human being committed:
- Recklessly
- During the commission of a lawful act in an unlawful manner
Capital Murder. Pursuant to Kansas Statute 21-3439, capital murder is:
- Intentional and premeditated killing of any person in the commission of a kidnapping
- Intentional and premeditated killing of any person pursuant to a contract or agreement to kill such person
- Intentional and premeditated killing of any person by an inmate or prisoner confined in a state correctional institution, community correctional institution or jail
- Intentional and premeditated killing of the victim of rape, criminal sodomy or aggravated criminal sodomy
- Intentional and premeditated killing of a law enforcement officer
- Intentional and premeditated killing of more than one person as a part of the same act or transaction or in two or more acts or transactions connected together
- Intentional and premeditated killing of a child under the age of 14 in the commission of kidnapping
Capital murder carries a life sentence.
