Driver charged with causing fatal accident sentenced to probation

There are several reasons why having legal counsel is important when charged with a crime. For one, being advised of one’s legal rights and options is paramount. It is critical that an accused understand the charges against them so that they can make informed decisions about whether to plead guilty or to take the matter to trial.

Also, a skilled lawyer can help a client understand whether a plea deal is in their best interests and can negotiate an agreement with the prosecution that can help the accused avoid jail time.  Such is likely the case with a 21 year-old man in Cass County who was charged with careless and imprudent driving resulting in an accident, for his actions in a crash that killed an elderly couple.

The man was recently sentenced. According to a Kansas City Star report, he received a suspended sentence for jail time, and was also required to perform community service and follow all requirements of his probation. He was also required to commit to alcohol monitoring.

The family of the couple killed was outraged with such a light sentence, and also because stiffer charges were not filed after the couple perished. However, the prosecutor reportedly explained to the family that the potential for a jury acquitting the man was a distinct possibility. Because of this, the prosecutor negotiated an agreement with the man’s attorney.

With that said, the story exemplifies the need for an experienced criminal defense attorney when charged with a crime in Kansas or Missouri.
