Understanding Kansas Rape Law

Kansas Statute 21-3502 defines rape as: Sexual intercourse with a person who does not consent to the sexual intercourse, under any of the following circumstances:

  • When the victim is overcome by force or fear
  • When the victim is unconscious or physically powerless
  • When the victim is incapable of giving consent because of mental deficiency or disease, which was known by the offender or was reasonably apparent to the offender
  • When the victim is incapable of giving consent because of the effect of any alcoholic liquor, narcotic, drug or another substance, which was known by the offender or was reasonably apparent to the offender

Rape is a felony and the penalty is prison time and mandatory sex offender registration.

Experienced Sexual Battery Attorney

I have extensive experience in defending clients on sex-related arrests. Prior to becoming a lawyer, I worked as an intern with the St. Louis Metropolitan Sex Crimes Unit. Unlike some lawyers, I understand how the other side thinks, and I know the process it uses to investigate crimes. I also have a comprehensive understanding of DNA and how DNA evidence is used in rape cases. I work hard to get the charges against you dismissed or mitigate the consequences so as to save your reputation.

Defenses to rape charges may include:

  • Consent (this defense does not apply to minors or victims who lacked capacity)
  • Lack of evidence or chain of custody issues
  • Improper police procedure
  • False allegations
