Marijuana is still illegal in Kansas

The use of marijuana for recreational and medicinal purposes is becoming more and more commonplace across the country. Kansas law has not been updated to reflect the changes that are occurring everywhere else. Marijuana is still illegal here, and you can face criminal charges if you are found with weed.

In Kansas law, as well as in federal law, marijuana is viewed as a controlled substance. It is ranked up there with methamphetamine and heroin. You can't legally possess, grow, cultivate or sell marijuana in this state -- not even for medicinal purposes.

If you are found to be in possession of marijuana for the first time, you are facing a misdemeanor that is associated with up to a year in jail. For a second offense, you are facing a Severity Level 5 drug felony that can mean 10 months up to 42 months in prison, depending on certain circumstances.

The charges and penalties for selling marijuana are even more serious. For less than 25 grams, you face a level 4 felony. From 25 to 450 grams, you will be charged with a level 3 felony. For 450 grams up to 30 kilograms, the charge is a level 2 felony. More than that would be a level 1 felony.

There are certain conditions that can mean you face an enhanced charge. These include selling the drug within 1,000 feet of a school.

All of these charges are serious, and you need to get your defense together if you plan on fighting them. You shouldn't waste time in doing so. Instead, get to work right away so that you have as much time as possible to plan and prepare.
