Kansas man in hospital custody after domestic violence death

Kansas investigators say they have arrested a 30-year-old man in connection with the death of a child in Leavenworth. The defendant in this case may be required to mount a criminal defense against serious allegations, including charges of first-degree felony murder. Authorities say that the man remains in a hospital, and he is being heavily guarded by police officers.

The man is accused of taking the girl from his girlfriend's home after the pair were engaged in a domestic dispute. The man fled police officers, venturing into Platte County during a high-speed chase. His vehicle was eventually stopped at a construction area, where he is accused of pointing a firearm at police officers. The man was shot during that encounter. His injuries were not thought to be life-threatening.

This is not the man's first experience with legal troubles. In fact, he had a bench warrant out for his arrest after he apparently failed to appear for a hearing about a series of domestic violence violations. He has a history of domestic battery and aggravated assault. Further, the victim's mother reportedly had a protection order against the man at one point, though it was not clear whether that was still in effect.

In addition to the murder allegations in this case, the man could face charges for kidnapping, child endangerment and criminal possession of a firearm, among other allegations. Many of those charges are considered aggravated, which would make potential penalties for the violent crimes even more severe. Even those defendants who are accused of the murder of a child deserve a fair legal proceeding. Those criminal defendants still have rights that should be protected in court, no matter the nature of the alleged crimes.
