Defendant could face mandatory sentence under Jessica's Law

A Kansas man is accused of molesting a child in Wichita. The defendant, age 34, is facing allegations of aggravated indecent liberties with a child after allegedly fondling or touching a 5-year-old in early April. The sex crime reportedly occurred on April 5.

Authorities report that the defendant was arrested on April 6 after a 30-year-old woman reportedly witnessed and phoned in the incident. He was taken into custody about an hour and half after that woman made the call. The defendant is accused of making the child lower his pants and underwear and touch his own genitals.

The man has spent time in prison for sex offenses in the past; Kansas Department of Corrections officials say that the man spent about four years in prison after a conviction in the early 2000s. The defendant had been accused of aggravated indecent liberties -- the same charge he currently faces -- in connection with an incident with an 8-year-old child in Sedgwick County, Kansas. His sentence ended in 2009.

In this case, the defendant is currently being held on a $250,000 bond. It does not appear that he has posted bail in order to secure his release. The man will appear in court again in late April. He could face a life sentence without parole for 25 years in connection with the allegations. The charges qualify as a sex offense under Jessica's Law, which mandates strict minimum sentencing guidelines for certain sex offenses.

Registered sex offenders who are accused of additional sexual assault may have special courtroom needs. Jessica's Law crimes have heavy implications that can lead to hefty criminal penalties. A Kansas attorney may be able to provide additional information and education about the impact of Jessica's Law on a criminal case.
